1. Introduction
Welcome to Hales Finance. These Terms of Service ("Terms") govern your use of our bill switching and financial management service ("Service") operated by Hales Finance Ltd ("we", "us", "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Be a resident of the United Kingdom
- Have a valid email address
- Have a UK bank account (for Open Banking bill detection features)
- Have the legal capacity to enter into a binding agreement
3. Account Registration
When you create an account with us, you must provide accurate and complete information. You are responsible for:
- Maintaining the security of your account access
- All activities that occur under your account
- Notifying us immediately of any unauthorised access
- Ensuring your contact information remains accurate and up to date
We use passwordless authentication (magic links) to secure your account. You must keep your email account secure and not share access with others.
4. Service Description
Hales Finance provides a bill management and switching service that:
- Detects Bills: Automatically identifies recurring bills from your connected bank transactions
- Compares Quotes: Searches for better deals on energy, insurance, broadband, and other services
- Facilitates Switching: Helps you switch to better deals either manually or automatically
- Sends Reminders: Notifies you of upcoming renewals and potential savings
4.1 Automation Modes
You can choose how we handle bill switching on your behalf:
- Manual: We show you quotes; you decide and initiate all switches
- Suggest: We recommend switches; you approve before we proceed
- Automatic: We automatically switch when savings exceed your threshold (you can cancel within 14 days)
You can change your automation mode at any time in your account settings.
5. Open Banking
To detect bills automatically, you may connect your bank account using Open Banking. By connecting your account, you:
- Authorise us to access read-only account and transaction data
- Understand we cannot make payments or move money from your account
- Can revoke access at any time via your bank or our Service
- Acknowledge connections expire after 90 days and require reauthorisation
Open Banking access is provided through FCA-regulated Account Information Service Providers (AISPs). Your bank credentials are never shared with us.
6. Bill Switching
When we facilitate a switch on your behalf:
- We act as your agent to find and compare deals
- We may receive referral fees or commissions from providers
- The contract is between you and the new provider, not with us
- You are responsible for reviewing and understanding the new contract terms
- Some switches may have cooling-off periods under consumer protection law
6.1 Quote Accuracy
While we strive to provide accurate quotes:
- Prices may vary from quotes due to provider terms and conditions
- Quotes are estimates based on information you provide
- Final pricing is determined by the service provider, not us
- We are not liable for differences between quoted and final prices
7. Subscription and Payments
7.1 Free Tier
Our free tier includes basic bill tracking and manual switching assistance. Features may be limited compared to premium plans.
7.2 Premium Subscription
Our premium subscription includes:
- Automatic bill switching
- Priority quote searches
- Advanced notifications and reminders
- Detailed savings analytics
7.3 Billing Terms
- Subscriptions are billed monthly or annually in advance
- You can cancel at any time; access continues until period end
- Refunds are not provided for partial subscription periods
- We reserve the right to change pricing with 30 days notice
8. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Provide false or misleading information
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated tools (bots, scrapers) to access the Service
- Reproduce, copy, or resell any part of the Service
- Use the Service to commit fraud or financial crime
We reserve the right to suspend or terminate accounts that violate these terms.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Hales Finance Ltd and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works from our Service without our express written permission.
10. Disclaimers
10.1 No Financial Advice
Our Service provides information and tools to help you manage bills. We do not provide financial, legal, or tax advice. You should seek professional advice for complex financial decisions.
10.2 Service Availability
We strive to maintain continuous service but do not guarantee:
- Uninterrupted access to the Service
- Error-free operation
- Availability of third-party services we integrate with
- Continued availability of specific quotes or switching options
10.3 Third-Party Services
We integrate with third-party providers for Open Banking, quotes, and switching. We are not responsible for:
- Actions or omissions of third-party providers
- Service disruptions from third parties
- Terms and conditions of contracts you enter with other providers
11. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim
- We are not liable for losses resulting from your failure to provide accurate information
- We are not liable for losses caused by third-party service providers
Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Hales Finance Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content or information you provide to us
13. Termination
13.1 By You
You may close your account at any time by contacting us or using the account settings. Upon closure:
- Your access to the Service will end immediately
- Any pending switches may be cancelled
- We will delete your data in accordance with our Privacy Policy
- Subscription fees already paid are non-refundable
13.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- We suspect fraudulent or illegal activity
- Required by law or regulation
- We discontinue the Service (with reasonable notice)
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you should stop using the Service.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you may also benefit from mandatory consumer protection laws of your country of residence.
16. Dispute Resolution

17. Severability

18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hales Finance Ltd regarding the Service. They supersede any prior agreements or communications.
